Adultery in Thailand: A Risky and Prohibited Practice

Share

Marital infidelity in Thailand is a serious offense with legal consequences for the adulterer and the third party involved. The law aims to protect the sanctity of marriage and discourage infidelity by imposing penalties such as fines, compensation, and loss of career or pension. Legal experts suggest that a legally married person has the option to sue a third party involved in an extramarital affair for compensation, but the lawsuit must be filed within a year of discovering the affair. The Royal Thai Army and Police have also announced disciplinary action against unfaithful members, including limitations on promotions and even dismissal from service. Civil servants can also be fired and have their pensions revoked for engaging in extramarital affairs.

One of the harshest penalties for marital infidelity in Thailand is the impact on career prospects, particularly for those in the civil or military service. The Royal Thai Army and Police take disciplinary action against members who are found to be unfaithful to their spouses, which can result in limitations on rank promotions, loss of bonuses, or even dismissal from service. The Civil Service Commission can also fire civil servants and revoke their pensions for engaging in extramarital affairs. These consequences apply to common-law relationships as well.

Another legal implication of marital infidelity in Thailand is the possibility of paying compensation to the cheated spouse. The law allows a legally married spouse to sue the third person involved in the affair for damages, but the lawsuit must be filed within a year of discovering the affair and evidence must be provided within six months. This legal option seeks to provide some form of compensation to the cheated spouse for the emotional harm caused by the affair.
